GaFT toolbox Trial Licence Agreement

IMPORTANT NOTICE:  This agreement is between the University of West Bohemia and the user and governs the use of the GaFT toolbox demo for use with the MATLAB® [1] . This agreement limits and excludes warranties and remedies regarding the software, materials and services, exempts University of West Bohemia and other person from liability or limits their liability, specifies the jurisdiction for resolution of disputes, and contains other important provisions that you should read. By downloading and installing the GaFT toolbox trial, you acknowledge and signify customer’s acceptance and agreement, without limitation or qualification, to be bound by this agreement and you represent and warrant that you have the legal authority to accept and agree to this agreement on behalf the customer. If customer does not agree with each provision of this agreement, or you are not authorized to agree to this agreement on behalf of customer, then neither you nor any other person on behalf of customer may download, install or use GaFT toolbox trial, and you must cancel the installation of the software and permanently delete and destroy all copies of the software in your possession or control.

LICENSE GRANT:  By downloading the GaFT toolbox demo the University of West Bohemia grants to Licensee a nonexclusive license to install and use the GaFT toolbox trial as provided by the installation procedure. The licensed GaFT toolbox trial is, and shall at all times remain, the property of the University of West Bohemia and Licensee shall have no right, title, or interest therein, except as expressly set forth in this Agreement.

INSTALLATION AND USE:  By accepting the terms and conditions of the Agreement, Licensee accepts the applicable rights and agrees to be bound by the applicable obligations and restrictions of the downloaded product License. The GaFT toolbox trial may be installed on any number of computers the Licensee has the right to use. The Licensee may not sell, license, sublicense, rent, or make the GaFT toolbox trial available for use by any Third Parties.

Licensee shall not provide access to the GaFT toolbox trial  via a Web application without procuring specific rights to do so. Licensee may make backup copies of the GaFT toolbox trial as necessary to support the use of the GaFT toolbox trial in accordance with this Agreement. Licensee may not remove any copyright, trademark, proprietary rights, disclaimer or warning notice included on or embedded in any part of the GaFT toolbox trial. All copies of Program shall contain all copyright and proprietary notices as in the original. Licensee may not alter or modify the GaFT toolbox trial without the consent of the copyright holders. In particular, Licensee may not alter, adapt, translate, or convert 'M­files' or 'P­code' contained in the Program in order to use those files with any products other than products of The MathWorks, nor may the Licensee incorporate or use 'M­files', 'P­code' or any other part of the GaFT toolbox trial in or as part of another computer program. All copies of the Program and Documentation, whether made by Licensee or otherwise, shall be subject to the terms of this Agreement. Licensee shall take appropriate action by instruction, agreement, or otherwise with any persons permitted access to the GaFT toolbox trial, so as to enable Licensee to satisfy its obligations under the terms of this Agreement.

DEMO PRODUCT STATUS:  The GaFT toolbox demo is offering limited features allowing the Licensee only to evaluate and test the GaFT toolbox trial. GaFT toolbox demo is not an end product (or finished appliance), nor is it intended or authorized by the University of West Bohemia to be integrated into end products. You are not authorized to use the GaFT toolbox demo in any production system, and may not be offered for sale or lease, or sold, leased or otherwise distributed. If the GaFT toolbox demo is incorporated in a demonstration system, the demonstration system may be used by the Licensee solely for internal evaluation and testing purposes.

LIMITED WARANTY:  THE UNIVERSITY OF WEST BOHEMIA DISCLAIMS ALL OTHER WARRANTIES, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, WITH RESPECT TO THE SOFTWARE AND THE ACCOMPANYING WRITTEN MATERIALS. NO REFUNDS WILL BE GIVEN.

IN NO EVENT WILL LICENSOR BE LIABLE TO YOU FOR DAMAGES, INCLUDING ANY LOSS OF PROFITS, LOST SAVINGS, OR OTHER INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF YOUR USE OR INABILITY TO USE THE SOFTWARE.
